“不当出生”案中医疗机构担责问题的对策研究

摘　　要：“不当出生”案件数量自2010年可查证以来呈逐年递增趋势,司法实践对其中医疗机构的担责问题也存在诸多争议点。本文以171例该类案件为基础,分析得出导致该类案件中争议较多的原因除案件事实认定困难外,还有法律层面以及道德层面的问题;针对司法实践中归责于医疗机构的现状与原因,给医疗机构提出了应对该类案件的策略,如保障患方知情同意权、履行转诊告知义务等。The number of"improper birth"cases has been increasing year by year since it can be verified in 2010,and there are many disputes about the responsibility of medical institutions in judicial practice.Based on 171 cases,this paper analyzes and concludes that disputes in such cases are not only caused by the difficulties in ascer⁃taining the facts of the case,but also by legal and moral problems.In view of the current situation and reasons imput⁃ed to medical institutions in judicial practice,this paper puts forward some strategies for medical institutions to deal with such cases,such as guaranteeing the patient's informed consent right and fulfilling the obligation of referral noti⁃fication.
