摘　　要：我国对于精神障碍患者的强制医疗程序的研究目前仍然主要着眼于强制入院阶段。在此阶段下,学者们主要从精神障碍患者的入院鉴定程序和临时性保护措施着手,试图在精神障碍患者入院前,以一种完善的法律模式来确定后来强制医疗程序的适用,做到“一劳永逸”,而对于精神障碍患者入院后的专断性治疗行为的规制则研究较少。近些年来,强制治疗阶段中的“医学模式”优于“法律模式”的传统思维定势得到了一些纠正,但是仍然存在不足之处。通过区分“强制入院”和“强制治疗”的区别,赋予患者拒绝治疗权,并通过内部审查听证程序、强制治疗定期评估制度和值班律师监督制度对患者入院后的强制治疗行为进行程序规制是现代社会的必然要求。At present,the research on the compulsory medical procedure of mental patients in China is mainly focused on the stage of compulsory admission.At this stage,scholars mainly start from the identification procedure and temporary protective measures of mental patients,trying to determine the application of criminal procedure and compulsory medical procedure with a legal mode before mental patients are admitted to hospital,so as to achieve"once and for all".However,there are few studies on the related procedures of behavior regulation of compulsory treatment of mental patients after admission.The emergence of this situation,on the one hand,is due to the scholars failed to recognize the particularity of mental health care,on the other hand,it is also due to the traditional legislature that once a person is identified as a mental patient and sent to the hospital,it should not be too much to use the legal model to regulate the follow-up compulsory treatment in the hospital,but should use a more professional medical model to regulate.It is caused by the idea of compulsive treatment.However,in the new era,the traditional legal mode of compulsory treatment has been further improved.by distinguishing between compulsory admission and compulsory treatment,we should endow patients with the right to refuse treatment,and constantly improve the system construction of the right to refuse treatment through the internal review hearing procedure,the regular evaluation system of compulsory treatment and the supervision system of lawyers on duty,so as to promote the standardization and rationalization of compulsory treatment in China.
