摘　　要：随着电子商务的迅速发展,人们对生活饮用水品质要求不断提高,网购涉水产品已成为潮流所趋。本案例是在开展对网络经营涉水产品监督检查中发现销售的进口涉水产品无卫生许可批件,处罚的主要依据是《上海市生活饮用水卫生监督管理办法》第十一条第一款和第四十五条第(一)项的规定。结合办案过程中遇到的违法主体认定、涉案产品数量的确定以及网络销售取证的特殊性等问题及难点,展开分析讨论,提出了相关意见和建议,为卫生行政部门处理类似案件提供参考和借鉴。With the rapid development of e-commerce and the continuous improvement of people’s requirements for drinking water quality,online shopping for water-related products has become a trend.This case is to carry out the supervision and inspection of the network management of water-related products found that the sales of imported water-related products without sanitary approval documents.The main basis for the punishment is the provisions of Article 11(1)and Article 45(1)of the Measures of Shanghai Municipality for the Supervision and Administration of Domestic and Drinking Water Sanitation.The author combined the problems and difficulties in the process of handling the case,such as the identification of the illegal subject,the determination of the quantity of the product involved and the particularity of the evidence collection in network sales,discussed and analyzed,and put forward some relevant opinions and suggestions.This case can provide reference and reference for the health administration to deal with similar cases.
