电子送达行政处罚文书的路径思考

摘　　要：修订后的《中华人民共和国行政处罚法》将“电子送达”方式写入条款之中,至此,行政处罚相关文书均可采用电子送达,甚至包括行政处罚决定书。作为一种新型的送达方式,电子送达具有操作简便快捷、方法多样、留证清晰等优势和更广阔的应用前景。尤其当前疫情防控形势依然严峻,加快推进电子送达能够减少密切接触、降低执法成本、提高执法效率。电子送达的途径多种多样,如搭建统一的电子送达平台送达、手机短信送达、电话录音送达、利用新型社交媒体送达,还有学者提出“基于手机支付为载体”的电子送达等,但每一种电子送达途径都有其优势和局限性。拟对电子送达方式进行阐述分析,明确电子送达的要点,提出一些推广电子送达的路径思考,有助于尽快将电子送达方式运用到执法实践中,提高执法能力,避免执法风险。Administrative Punishment Law of the People’s Republic of China has specifically added electronic service method into the terms.Since then,administrative law enforcement documents can be electronic delivered,even including administrative penalty decision.Its scope of application is greater than the relevant provisions of electronic service in Civil Procedure Law of the People’s Republic of China.As a new delivery method of administrative law enforcement,electronic service has the advantages of simple and fast.Diversified methods can be used in practice and a complete chain of evidence is easy to maintain.Therefore,it can be anticipated that this new method will be broadly applied.Especially at present the situation of epidemic prevention and control remains grim.Electronic service can reduce close contact,lower law enforcement costs and improve law enforcement efficiency.There have been various ways of electronic service,such as building a unified electronic service platform,mobile phone text message delivery,phone-call recording delivery and new social media delivery,etc.Even some scholars have put forward an electronic service method based on mobile payment as the carrier.However,each way of electronic service has its advantages and limitations.Hence this paper intended to summarize the key points of electronic service through elaborate and analyze the ways of electronic service.Meanwhile,it also put forward some path thinking of promoting electronic service which dedicates to put electronic service into practice as soon as possible for the sake of improving law enforcement ability and avoiding law enforcement risks.
