摘 要:医师多点执业是医疗卫生体制改革进程中的重要一步,其积极意义表现在促进医疗资源均衡合理配置、推动医疗机构的人才流动纳入市场竞争。通过阐明目前医师多点执业的立法现状和实施现状可以发现,该政策推行缓慢的原因之一在于法律风险的阻碍。基于第一执业机构的视角,医师多点执业带来的法律风险有三个方面,即医师人事管理风险、医疗侵权纠纷风险以及医疗行业不正当竞争风险。因此,应当针对上述提及的风险,建立新型人事管理制度、健全医疗侵权纠纷预防和处理机制以及完善竞业限制机制,从而架构起现实有效的法律风险防控机制,最终助推医师多点执业顺利实施。Physician’s multi-sited practice is an important step in the process of health reform.Its positive significance is to promote the balanced and rational allocation of medical resources and to promote the flow of talents in medical institutions into market competition.By clarifying the current legislation and implementation status of multi-sited practice,it can be found that one of the reasons for the slow implementation of this policy is the obstruction of legal risk.From the perspective of the first registered institution,the legal risks brought by multi-sited practice include three aspects,the risk of doctors’personnel management,the risk of medical tort disputes and the risk of unfair competition in the medical industry.In view of the risks mentioned above,therefore,we should establish a new personnel management system,perfect the prevention and handling mechanism of medical tort disputes and improve the competition restriction mechanism,so as to build a practical and effective legal risk prevention mechanism,finally promoting the successful implementation of multi-sited practice.
