摘 要:随着更高水平的平安中国建设和新时期“枫桥经验”的深入开展,建立完善警察民事调解制度的重要性日益凸显。当前,我国已具备构建警察民事调解的法律与政策基础,各地在推动警察民事调解中也有诸多探索并取得积极成果。我国警察民事调解制度面临着主体力量不足、调解范围模糊、无专门程序规定和配套机制不足等问题。从本土实践出发,借鉴域外经验,立法上明确警察民事调解职权,合理界定调解的范围,同时拓宽警察民事调解与其他调解的流转与协同,构建有中国特色的警察民事调解制度。The importance of establishing and improving the police civil mediation system has become increasingly prominent, with the construction of a higher level of peace in China and the in-depth development of the “Fengqiao experience” in the new era. At present, we have the basis of legal and policy in China, there are also many explorations and positive achievements in the practice of promoting police civil mediation. Many problems faced by civil mediation system of police: such as insufficient subject force, vague mediation scope, no special procedure provisions and insufficient supporting mechanisms in China. We should define the legal authority of police civil mediation, reasonably define the scope of legal mediation, and open up the circulation and coordination of various legal mediation to build a police civil mediation system with Chinese characteritics, based on local practice and foreign experience.
