摘　　要：元宇宙是一个平行于现实世界的多维度虚拟世界,元宇宙空间特殊的社会形态和技术形态给人们的生产、生活方式带来巨大变革,引发了全球范围的热议和讨论。在元宇宙利用区块链、人工智能、数字交互等技术可以生成丰富的虚拟数字作品,但由于法律规制具有一定的滞后性,虚拟数字作品在实践、客体、权利等多维度呈现出无序扩张的问题。通过引入“三步检验法”、吸纳“转换性使用”规则、重塑弹性的“合理使用”制度等方式,架构我国合理使用的本土化路径,平衡作者利益和公共利益之间的关系,以期解决当下虚拟数字作品著作权扩张的难题,推动元宇宙产业的健康发展。The metaverse is a multi-dimensional virtual world parallel to the real world, which has aroused heated debates and discussion around the world. In which, blockchain, artificial intelligence, digital interaction and other technologies can generate rich virtual digital works. However, due to the certain lag of legal regulation, virtual digital works show a problem of disorderly expansion in practices, objects, rights and other dimensions. By introducing the "three-step test", absorbing "conversional use rules", and reshaping the elastic "copyright protection-reasonable use system", a multi pronged approach to the localization of rational use in China has been established to balance the relationship between authors and public interests, so as to solve the current problems of copyright expansion of virtual digital works and promote the healthy development of the meta universe industry.
