铸牢中华民族共同体意识的法理阐释——以《地方组织法》为例

摘　　要：《中华人民共和国地方各级人民代表大会和地方各级人民政府组织法》是关于地方组织制度的基本法律和法治保障,2022年作出第六次修改。此次修法意义重大,亮点之一在于增加了铸牢中华民族共同体意识的内容。在法理层面,此次修法整体上提升了铸牢中华民族共同体意识的法治地位,使其从对地方组织的政策要求转变成了法定职责;框定了铸牢中华民族共同体意识的法治内容,将少数民族的抽象权利细化到了合法权益;转变了铸牢中华民族共同体意识的法治思维,使其从尊重习惯具体到了保障自由;确立了铸牢中华民族共同体意识的法治方式,使其从应当采取发展到了可以依法采取。《地方组织法》的修订是铸牢中华民族共同体意识在地方组织法律制度建设上的重大发展。Organic law of the local people’s congress and local people’s governments of the PRC is the basic law and legal guarantee of the local organization system. The law was amended for the sixth time in 2022. This revision of the law is of great significance. One of the highlights is the addition of content on consolidating a strong sense of community for the Chinese nation. At the jurisprudential level, the amendment as a whole has enhanced the legal status of consolidating a strong sense of community for the Chinese nation, turning it from a policy requirement to a legal responsibilities for local organizations;It frames the content of the rule of law in consolidating a strong sense of community for the Chinese nation, and turns the abstract rights of ethnic minorities into legitimate rights and interests;It has changed thethinkingof rule of law in consolidating a strong sense of community for the Chinese nation, specifying it from respecting local customs to ensuring freedom;It has established path for the rule of law in consolidating a strong sense of community for the Chinese nation, making it develop from what should be adopted to what can be adopted according to the law. In short, this amendment is a significant development in the construction of the legal system of local organizations in consolidating a strong sense of community for the Chinese nation.
