“原情定罪”考辨

摘　　要：由于在中国古代多种语境下的复杂运用,“原情定罪”的含义处于不确定状态。综合考察中国古代“原情定罪”的运用情形,“原情定罪”中“原”字的基本含义是考察、推究、研究;“情”字的基本含义是犯罪事实,具体含义则比较丰富,包括犯罪行为、犯罪的主观状态、犯罪人的言辞和情态以及其他具体的事实、情节等内容,犯罪动机和人伦亲情也是其中重要的两项;“罪”字的含义包括罪之有无、罪过大小、罪行(罪愆)轻重和具体刑罚等几个方面。因此,“原情定罪”的基本含义是在考察、推究具体案情的基础上,确定行为人是否有罪、罪过的大小和具体的刑罚。当然,在涉及家族人伦关系的犯罪中,行为人的动机、行为目的与家族人伦关系的关联是定罪量刑必须考量的情节,但不是唯一情节,更不是“原情定罪”的基本含义。Due to the complexity in its application in various contexts,the ancient Chinese legal notion yuanqing dingzui原情定罪is understood in different ways.The basic meaning of the morpheme yuan原in the term was used as a verb,meaning“to examine,inquire,and study”.The basic meaning of the morpheme qing情was used as a noun,meaning“corpus delicti”,but its specific meaning was much richer than this,including the criminal act,the subjective state of the crime,the words and mood of the offender and other specific facts and circumstances in different contexts.Even the motive of the crime and human relations were also two important readings of qing in some specific contexts.The meaning of the morpheme zui罪was used as a noun,referring to several aspects such as the existence of the crime,the size of the crime,the severity of the crime(crime derivation)and specific penalties.Therefore,the basic meaning of yuanqing dingzui is to determine whether the perpetrator is guilty,the size of the crime and the specific penalty on the basis of examining and inquiring into the specific circumstances of the case.Of course,in crimes involving family relationships,the motivation of the perpetrator,the purpose of the act and the relationship between kinship members are circumstances that must be taken into account for conviction and sentencing,but they are not the only circumstances and are not part of the basic meaning of yuanqing dingzui.
