迈向法典的党内法规体系化建设

摘　　要：党内法规法典化是成文制度的发展趋势,对于确保制度协调融贯、提升体系化效应,促进依规治党事业高质量发展十分必要。其客观可行性在于管党治党制度体系已更加成熟定型,具备较长时期的稳定性和延续性;主观可行性在于形成了新时代依规治党重要思想、已有体系化立规初步经验、研究队伍日益壮大。现阶段应以适度体系型法典化为目标,因为党的团结统一、自我革命的特质决定了党内治理不适用回应型法治对应的汇编型法典,而党的制度建设仍将继续发展决定了体系型法典应规模适中。建议对表法治中国建设规划设定编纂目标任务,实行先易后难工作策略,明确四大板块各自内部以及跨板块之间体系化整合的方向和思路,起草党的组织机构法典、领导法规总则、纪律条例、工作责任制条例、领导干部条例、党员条例等,积极稳妥推进法典化。The codification of party rules is of vital importance for pushing forward the rulebased governance over the CCP and the development of the discipline of party rules,and of especial necessity for ensuring the coordination and coherence of norms and improving the systematic effect.At the centenary of the Party founding,the system of party rules has been"more mature and solidified",and the codification is needed in order to consolidate and develop the system.The thought of rulebased governance over the Party in the new era has provided a theoretical basis;the experience of the systematic formulation of rules is available and the codification is feasible in terms of the subjective and objective aspects,thus the moderate codification should be the goal at the present stage.The Party’s characteristics of unity and self-revolution determine that there are no grounds for codification in the area of governance within the party,and the moderate codification refers to a medium-scale systematized code.It is suggested that we should set working goals of codification in conformity with the Plan of Building the Rule of Law in China,implementing the strategy of"advancing from easy to difficult parts",and clarify the direction and way of thinking of the systematization within and across the four sections of party rules,for example,Party’s Organization Code,General Provisions on Party’s Leadership,Regulations on Disciplines,Regulations on Accountability for Work,Regulations on Leading Officials,and Regulations on Party Members,putting forward the codification of party rules actively and stably.
