环境公益诉讼研究的演进、特征与展望——基于2003—2021年CNKI文献的Citespace可视化分析

摘　　要：文献分析结果表明,我国环境公益诉讼研究议题围绕环境公益诉讼制度程序创新、环境司法专门化、《民法典》相关绿色条款以及生态环境损害赔偿诉讼对比分析四个维度展开;在研究趋势上,研究议题的转向和深化与实务发展动向密切相关;在研究特征上,当前学界研究主要倾向于功能主义、结果主义和还原主义的研究风格,表现出理论研究、研究结果的效果回溯研究以及整体论研究滞后的发展缺陷;在研究转向上,应强化对经典研究议题的理论阐释,关注环境公益诉讼研究结果的效果评估,推进整体主义视角下对环境公益诉讼立法类型和制度建构路径的学术探讨,以此构建环境公益诉讼研究的科学体系,服务司法实务之发展。The results of literature analysis show that the research topics of environmental public interest litigation in China focus on four dimensions: the innovation of environmental public interest litigation system and procedure, the specialization of environmental justice, the relevant green provisions of the Civil code and the comparative analysis of ecological environment damage compensation litigation;in terms of research trend, the turning and deepening of research topics are closely related to the development trend of practice;in terms of research characteristics, the current academic research mainly tends to the research styles of functionalism, consequentialism and reductionism, showing the development defects of theoretical research, the effect retrospective research of research results and the holism research;in the research turn, we should strengthen the theoretical interpretation of classical research topics, pay attention to the effect evaluation of the research results of environmental public interest litigation, and promote the academic discussion on the legislative types and system construction path of environmental public interest litigation from the perspective of holism, so as to build a scientific system of environmental public interest litigation research and serve the development of judicial practice.
