摘　　要：家事案件具有独特的伦理和情感属性。为有效解决家事纠纷,家事审判方式改革中“引入”了家事调查员制度。剖析67份样本文书发现,我国家事调查员制度在试点运行中尚存在家事调查员制度适用范围不清,家事调查报告的法律性质模糊等问题。究其根本,源于家事调查制度职能定位不明,“民事家事合一”之传统审判模式难以适应家事纠纷的特殊性。为充分发挥家事调查员制度的功能,需明确家事调查员制度的司法辅助调查功能,明确家事调查员的角色定位和遴选条件,并规定家事调查报告的司法属性以及家事调查员的管理方式。Family cases have unique ethical and emotional attributes.In order to effectively solve family disputes,the family investigator system has been introduced into the reform of family trial mode.By analyzing 67 sample documents,it is found that there are still some problems in the pilot operation of China's family investigator system,such as unclear scope of application of family investigator system and vague legal nature of family investigation report.The root cause is that the function of the family investigation system is unclear,and it is difficult for the traditional trial mode of"unification of civil and family affairs"to adapt to the particularity of family disputes.In order to give full play to the functions of the family investigator system,it is necessary to clarify the judicial auxiliary investigation function of the family investigator system,specify the role and selection conditions of family investigators,and ascertain the judicial attributes of family investigation reports and the management methods of family investigators.
