论刑事涉案财物处置中对第三人财产权益保护

摘　　要：我国刑事诉讼长期侧重关注被追诉人的人身权保障,而对被追诉人、被害人以及相关第三人等财产权益保障以及刑事诉讼涉案财物管理研究相当匮乏。《民法典》的出台对保障我国公民财产权益具有重大意义,但刑事涉案财物处置中保障第三人民事财产权的相关立法仍存不足,具体包括:涉案财物处置过程中的范围界定不清、强制处分过度失范、处置工作严重滞后以及救济渠道不顺畅等诸多问题。结合刑事法律法规及相关司法解释,对照《民法典》中关于公民财产权利保护之规定,应当在遵循诉讼法基本原理的大前提下,借鉴司法实践有益经验,通过完善制度设计、规范处置流程、建立工作机制、畅通救济渠道等保护第三人财产权的措施,以解决二者之间的冲突与平衡。In our country,the protection of the personal rights of the accused has long been the focus of attention during criminal procedure,while the research is rather deficient on the protection of property rights and interests of the accused,the victims and the related third party and the management of the property involved in criminal procedure.The promulgation of the Civil Code is of great significance to the protection of the property rights and interests of our citizens,but the relevant legislation for the protection of the third party's civil property rights in the disposal of property involved in criminal cases is still insufficient.This insufficiency includes:unclear definition of the scope of the property disposal,excessive and irregular compulsory disposal,serious delay in disposal and unsmooth relief channels,etc.In the light of the criminal laws and regulations and the relevant judicial interpretations,and according to the provisions on the protection of citizens'property rights in the Civil Code,we should,on the premise of following the basic principles of the procedural law,draw lessons from the beneficial experience of judicial practice by perfecting the system design,standardizing the disposal process,establishing the working mechanism,unblocking the relief channels and taking other measures to protect the property rights of the third party in order to solve the conflicts and unbalance between the two.
