摘  要:数字经济时代,平台依托数据、算法等新型生产要素,给市场竞争带来新的波澜,垄断化和资本无序扩张阻碍市场公平竞争与企业的创新发展,损害消费者权益和个人信息。技术的更新迭代更是使得垄断和不正当竞争愈加系统化、精准化、隐秘化、智能化,传统的市场份额和市场结构已不足以推定企业在相关市场内的市场支配地位。我国相关法律制度虽然已重视平台经济的特征并作出细化与修正,但仍存在漏洞与不足,对此考量因素仍需加以扩充具体化,以期能够达到更高效、更精确运用到实践中的效果。In the era of digital economy,digital platforms rely on data,algorithms and other new production factors,bringing new influence to market competition.Monopolization and disorderly expansion of capital hinder fair market competition and innovative development of enterprises,and damage consumer rights and personal information.The update and iteration of technology makes monopoly and unfair competition more systematic,precise,secretive and intelligent.The original market share and market structure are no longer enough to infer the dominant position of an enterprise in the relevant market.Although the relative laws and regulations have paid attention to the characteristics of platform economy and made revision,there are still loopholes and deficiencies.Therefore,the consideration factors still need to be expanded and specific,so as to achieve more efficient and accurate application in practice.
