摘 要:党的十八大以来,党中央持续保持反腐败高压态势,不敢腐的氛围进一步强化。反腐败没有完成时。为了继续强化“不敢腐”震慑效应,引入相应理论模型,认为“腐败发现概率”“腐败调查概率”“腐败判处概率”及“腐败惩处力度”将直接影响到“不敢腐”战略目标的实现。结合这一分析视角,揭示出大数据反腐制度不健全、反腐败机构独立性不够、腐败犯罪规制范围不严密、罪刑不相适应等诸多制度漏洞,最后简要提出堵住这些制度漏洞的政策选择,即建立独立、廉洁、授权充分的反腐机构,完善惩治腐败的刑事法治体系,加强大数据反腐败能力建设以及强化廉洁教育震慑效应。Since the 18th National Congress of the Communist Party of China(CPC),the CPC Central Committee has continued to maintain a high pressure against corruption,and the atmosphere of fear of corruption has been further strengthened.The anti-corruption is not completed.In order to continue to strengthen the deterrent effect of"dare not corrupt",the paper introduces the corresponding theoretical model,and believes that"probability of corruption discovery","probability of corruption investigation","probability of corruption punishment"and"intensity of corruption punishment"will directly affect the realization of the strategic goal of"dare not corrupt".Combined with this analysis perspective,it reveals many institutional obstacles,such as imperfect big data anti-corruption system,insufficient independence of anti-corruption institutions,loose regulation scope of corruption crimes,and incompatibility between crime and punishment.Due to space limitations,at the end of the paper,policy options to address these institutional barriers are briefly proposed,namely,establishing an independent,honest and fully authorized anti-corruption institution,improving the criminal rule of law to punish corruption,strengthening the capacity building of big data anti-corruption,and strengthening the deterrent effect of integrity education.
