监管体系的解析与完善:旅游监管组织条款的规范分析

摘　　要：良好的行业秩序离不开优质的制度保障,旅游监管组织条款是从监管主体角度出发构建旅游监管体系的重要规范指引,也是旅游监管形式、监管内容的制度载体。通过法释义学的方式,基于“权威必须是开放性的、参与性的”原则指引,指出当前旅游监管体制中监管机构建制条款和治理条款存在缺陷,进而深层次的分析出监管机构建制条款和治理条款中所涉协同监管、职权互动、人员管理、责任保障四个方面的规范缺失给旅游监管造成的巨大影响。为了建构完善的旅游行业监管体系,提出以下完善对策:一在鼓励跨部门协同要素指引下确立旅游监管部门的协同规范;二在权力需要做到明确与透明要素指引下确立旅游监管职权互动规范;三在任职专业化要素指引下确立监管人员的任职保障规范;四在合理性要素指引下确立旅游监管内部制裁规范。Good industry order is inseparable from high-quality institutional guarantee.Tourism supervision organization terms are not only an important normative guide for constructing tourism supervision system from the perspective of supervision subject,but also an institutional carrier of tourism supervision form and content.Through the way of legal hermeneutics,based on the principle of“authority must be open and participatory”,this paper points out that there are defects in the institutional provisions and governance provisions of regulatory institutions in the current tourism supervision system,and then deeply analyzes the great impact on tourism supervision caused by the lack of norms in the four aspects of collaborative supervision,authority interaction,personnel management and responsibility guarantee involved in the institutional provisions and governance provisions of regulatory institutions.In order to construct a perfect tourism industry supervision system,this paper puts forward the following countermeasures:First,establish the coordination norms of tourism supervision departments under the guidance of encouraging cross departmental coordination elements;Second,establish the interactive norms of tourism supervision functions and powers under the guidance of clear and transparent elements of power;Third,establish the job security norms of supervisors under the guidance of professional elements;Fourth,establish the internal sanctions norms of tourism supervision under the guidance of rationality elements.
