共同防治新型网络犯罪研究——犯罪网络化趋势应对与治理体系构建

摘　　要：新型网络犯罪大幅增长,其共同犯罪特征明显;以利用网络实施的犯罪占多数,并向各个领域扩张,本质是犯罪的网络化趋势;新型网络犯罪重罪案件增加,“复合”传统犯罪,社会危害性大;犯罪主体前科劣迹并不突出,低龄化特征明显。新型网络犯罪“复合”传统犯罪的发展规律和犯罪网络化的性质特点,利用信息技术犯罪手段更新速度超过立法和司法对相关犯罪行为的调整与适应速度,使犯罪治理存在较大困难。犯罪治理和政策、侦查取证、案件管辖和办案方式等具体治理层面存在一定缺陷。共同防治新型网络犯罪很大程度是犯罪网络化趋势的应对与治理,需构建犯罪网络化趋势应对与治理体系,包括犯罪打击和网络治理两条主线:一是加大对新型网络犯罪重点领域罪名的研究与适用;二是加强侦查取证指引;三是明确新型网络犯罪跨区域管辖等问题;四是内外联动,构建新型网络犯罪共同防治机制。With the new type of cybercrime increasing significantly,the characteristics of its joint crime commission are obvious.The essence of criminal internetizing is that most of crimes are committed by using the Internet and expanding to various fields.The new cybercrime has increased in number and once it is committed,it is usually a felony.As it is integrated with traditional crime,it usually has a harmful effect on the society.The main criminals usually have no criminal records and tend to be at young age.Its development rule is that it is integrated with traditional crime and its nature and characteristics is Internetizing.The new kind of criminals armed with IT can renew their criminal methods faster than legislation and judicial departments adjust and adapt to relevant criminal acts,thus making it difficult to control such crime.What’s more,certain defects exist in specific governance such as crime governance and policy making,investigation and evidence collection,case jurisdiction and case handling methods.To a great extent,joint prevention and control of new cybercrime is to respond to and curb the trend of the crime Internetizing.So it is necessary to build a response and governance system for such trend,including two main fields of crime combat and Internet governance:1.increase the research and application of charges in key areas of new cybercrime;2.strengthen the guidance of investigation and evidence collection;3.clarify the transregional jurisdiction of such crime;4.internal and external cooperation to build a good joint prevention and control mechanism.
