基于SWOT分析的社会治理型检察建议刚性化研究——以H省各地市大数据为例

摘　　要：自党的十八大提出建设平安中国的目标,再到党的第十九届五中全会公报确立了以完善共建共治共享的社会治理制度为核心的目标,无不体现社会治理的重要性。社会治理是社会民生的关键性保障,更是国家治理的关键性一环。检察建议作为检察机关参与社会治理的重要方式,检察建议制度刚性化对我国社会治理具有重要意义。但是有关检察建议的研究文章、影响范围较小并没有引起学界的广泛探讨。基于SWOT分析法,对H省14个地市检察院检察建议的刚性化及规范化程度等方面进行大数据调研,对检察建议的概念、特征、实践情况等作分析总结,对我国检察建议制度的发展提出了一些建议,以期对检察机关的工作能有些许帮助。The 18 th National Congress of the Communist Party of China put forward the goal of building a safe China, and then the communiqué of the Fifth Plenary Session of the 19 th Central Committee of the Communist Party of China established the goal of perfecting the social governance system of co-construction, co-governance and sharing, all of which reflected the importance of social governance. Social governance is the key guarantee of people’s livelihood, and it is also the key link of national governance. Procuratorial suggestion is an important way for procuratorial organs to participate in social governance, and the rigidity of procuratorial suggestion system is of great significance to our social governance. However, the research articles on procuratorial suggestions have little influence and have not aroused extensive discussion in the academic circles. Based on SWOT analysis, this paper makes a big data survey on the rigidity and standardization of procuratorial suggestions of 14 procuratorates in H province, analyzes and summarizes the concept, characteristics and practice of procuratorial suggestions, and puts forward some suggestions on the development of procuratorial suggestion system in China, in order to be of some help to the work of procuratorial organs.
