基于中国式扶贫实践的给付行政法治创新

摘　　要：中国式扶贫实践推动形成了中国式给付行政的法治模式,即以发展型给付为基础逻辑,以共享型给付为长远目标的新型给付行政。发展型给付源于公民发展权保障国家义务,是在绝对贫困治理阶段,通过社会整体性发展累积给付资源,助推个体民生保障之给付行政。共享型给付源于公民共享权保障国家义务,是在相对贫困治理阶段,通过均等化公共供给与优化分配机制,追求实现共同富裕目标下的共享发展成果之给付行政。发展型给付与共享型给付,共同实现了对给付行政法治的创新再造:确立了“更多更公平的共享”给付原则,衍化出覆盖生存、发展和共享利益保障的给付模式,衍生出积极作为的最佳给付行政职能。特别是共享给付目标的确立,是在分配方式方面对“中国式现代化”最生动的诠释。发展型给付与共享型给付的法治理论凝成,将为全球贫困治理提供中国智慧和中国方案。Practice of poverty alleviation of China has led to the formation of the Chinese-style mode of rule of law concerning supply administration with development-based supply as the basic logic and sharing-based supply as the long-term goal.The former,which originates from the state’s obligation of protecting citizens’rights to development,refers to the supply administration in the phase of absolute poverty control,when supply resources are accumulated through the overall development of society to promote the livelihood of the individual.The latter,which originates from the state’s obligation of protecting citizens’rights to sharing,refers to the supply administration in the phase of relative poverty control,when the sharing of development achievements is realized under the goal of common prosperity for all by equalizing public supply and optimizing the distribution mechanism.Development-based supply and sharing-based supply together realize the innovational creation of the supply administration theory,that is,the establishment of the supply principle of“more and fairer sharing”,the evolution of the supply mode that covers subsistence,development and sharing of benefit,and the derivation of the function of the best supply administration.In particular,the establishment of the goal of sharing-based supply is precisely the most vivid interpretation of the Chinese-style modernization.The theoretical integration of development-based supply and sharing-based supply will provide the Chinese wisdom and the Chinese approach for global poverty governance.
