摘 要:近代化改革运动导致宗法文化赖以形成的“前现代”要素式微,现代化要素植入乡村,对宗法文化的多元压制力量形成,宗法文化退出了乡村治理领域的主导地位。然而,人们仍然基于“惯性”在宗法文化的指引下创建并延续“村落共同体”,并以宗法文化规范和引领自己的生产和生活实践。传统意义上的宗族或其房支在村委选举中保持较为一致的选举取向并成为影响选举结果的重要力量,姻亲以及拟制血亲亦在宗法文化指引下在村委选举中分担着传统宗族的结构性功能。在现代法治程序与原则的严格规制之下,宗法文化实现了对现代法治的有限参与,传统宗法文化对乡村社会的法治化的参与是影响中国农村法治现代化进程的一个值得重视的问题。The modernization reform movement led to the decline of the“pre-modern”elements on which the patriarchal culture was formed.The modernization elements were implanted in the countryside,and the multiple suppression forces on the patriarchal culture were formed,as well as the patriarchal culture withdrew from the dominant position in rural governance.People create and maintain the“village community”under the guidance of patriarchal culture based on“inertia”,and use the patriarchal culture to regulate and guide their production and life practices.Thus,the patriarchal culture grows“against the trend”after changing the role.The traditional clans or their house branches maintain a relatively consistent orientation in the election of villagers’committees and become an important force affecting the election results.In-laws and fictitious blood relatives also share the structural functions of traditional clans in the election under the guidance of patriarchal culture.Under the strict regulation of modern rule of law procedures and principles,patriarchal culture has achieved limited participation in modern rule of law.
