专利蟑螂规制的法理分析

摘　　要：专利蟑螂行为违背了专利制度的伦理基础,损害了制度内在利益平衡机制,构成了权利滥用并产生外部负效应,从而导致制度异化,对其进行规制具有充分的理论依据。规制专利蟑螂应选择以行为规制为主、主体规制为辅,私法手段和行政法手段并用和以治理专利蟑螂滋生的制度环境为主的策略并谨慎处理各利益主体间的利益平衡问题.The behavior of patent trolls violates the ethical basis of the patent system,damages the internal interest balance mechanism of the system,constitutes the abuse of rights and produces external negative effects,which leads to the alienation of the system,in which case there is sufficient theoretical basis for its regulation.The regulation of patent trolls should be based on behavior regulation,supplemented by subject regulation,use both private law and administrative law means,and control the institutional environment where patent trolls breed and carefully deal with the balance of interests among various stakeholders.
