摘 要:大数据时代,人工智能的发展促进了债务催收行业的转型,使得原本基于合法债权的催收行为发生异化,若不对传统监管格局加以革新,恐难以应对智能化催收下对债务人权利的侵犯。美国《公平债务催收作业法》较为健全的监管机制值得借鉴,但未来中国《债务催收行业管理条例》或《债务催收行业管理法》的制定,除了吸纳美国《公平债务催收作业法》所确立的基本监管框架外,更应当对智能化背景下催收行业的监管缺口进行批判性评估,通过大数据、区块链的运用,及时发现和规制不当催收行为。In the era of big data,the development of artificial intelligence has promoted the transformation of the debt collection industry,making the original collection behavior based on legitimate claims alienated.If the traditional regulatory pattern is not innovated,it is afraid that it will be difficult to cope with the violation of debtors’ rights under intelligent collection.The more robust regulatory mechanism of the U.S.Fair Debt Collection Practices Act is worth learning from,but in addition to absorbing the basic regulatory framework established by the U.S.Fair Debt Collection Practices Act,the future formulation of China’s Regulations on the Debt Collection Industry should critically assess the regulatory gap in the collection industry in the context of intelligence,and timely detect and regulate improper collection practices through the use of big data and blockchain.
