摘　　要：随着人口老龄化时代的到来,老年人犯罪与刑罚问题,已经成为当下人们关注的热点。试从法制史的角度分析中国古代老年人犯罪宽宥制度的内涵及其形成的原因,并积极探寻该制度对新时代中国法治社会的借鉴意义,以期完善我国老年人犯罪的相关制度。With the coming of aging society,the issue of crime and punishment of the elderly has become the focus of social attention.Based on the analysis of the ancient Chinese law,this paper makes a concrete analysis on the connotation and causes of the criminal system of the elderly from the perspective of legal history,with a view to improve the relevant systems of contemporary Chinese elderly crime by absorbing the spiritual factors that have not yet lost their value,and to explore the reference significance of this system to the contemporary Chinese society.
