民法典与民事诉讼法的衔接与协调——以证明标准为角度

摘　　要：基于法律适用的需要,推进民法典与民事诉讼法的有机一体化应成为研究的重中之中。民事证明标准兼具实体与程序的双重属性,以解决其适用困境为切入点,通过形成完整内在证明标准逻辑体系,明确及细化特殊证明标准,加强裁判文书说理性,对法官开展专项训练,最终实现民法典与民事诉讼法衔的有机一体化。Based on the needs of the application of law,promoting the organic integration of the Civil Code and the Civil Procedure Law should be the top priority of research.The civil proof standard has the dual attributes of substance and procedure,and takes solving its application dilemma as the starting point.By forming a complete logical system of internal proof standards,it defines and refines special proof standards,strengthens the rationality of judgment documents,and conducts special training for judges.Finally,the organic integration of civil code and civil procedure title will be realized.
