摘　　要：为鼓励责任主体在发生海难事故后及时赔付债权人,防止损失扩大,减少社会纷争,对海事赔偿责任限制基金中代位受偿权制度进行研究。通过规范分析法、比较研究法等,明确如下:代位受偿权自责任主体在责任限制基金分配之前对债权人作出赔付时产生;责任主体向基金提出代位受偿申请的数额为先行获得赔付的债权人的债权总额;责任主体以自己的名义行使代位受偿权;诉讼时效自原债权人取得原债权之日起算;行使程序包括责任主体提交代位受偿申请和海事法院对申请进行审查两个阶段。建议在修改《海商法》时赋予海事赔偿责任限制基金中的责任主体以代位受偿权,并在修改《海事诉讼特别程序法》时增加有关代位受偿权的行使名义和行使程序的规定。In order to encourage the persons liable to pay the creditors in time after marine accidents,prevent the expansion of losses,and reduce social disputes,the right of subrogation under the limitation fund of liability for maritime claims is studied.Through the normative analysis method and the comparative analysis method,it is clear as follows:the right of subrogation is generated when the person liable pays the creditor before the distribution of the limitation fund of liability;the amount of the subrogation claim brought by the person liable against the fund shall be the total amount of the claim of the creditor who has received an interim payment;the person liable shall exercise the right of subrogation in the name of himself;the limitation of action shall be calculated from the day when the original creditor acquires the right;the exercising procedure includes two stages which are the submission of the application for subrogation by the person liable and the review of the application by the maritime court.It is suggested to confer the right of subrogation on the persons liable under the limitation fund of liability for maritime claims when amending the Chinese Maritime Code,and to add provisions on the name and procedure of exercising the right of subrogation when amending the Chinese Special Maritime Procedure Law.
