网络知识产权犯罪的规范构造与规制路径——以平台责任为切入点

摘　　要：网络社会的勃兴在拓展行动场域之余,也深刻变革网络知识产权犯罪的规范构造。现实社会的知识产权犯罪呈现以内容方为核心的单一规范构造;而网络知识产权犯罪则呈现内容方与渠道方(网络平台)双核心的复合规范构造。现行以“通知—删除”规则、侵犯知识产权类罪名为支柱的知识产权保护体系在实践中效用有限:前者不当压缩平台责任;后者无视平台责任。拒不履行信息网络安全管理义务罪为追究平台的网络知识产权保护责任提供制度可能,却也面临义务范围不明确、适用范围窄等问题。网络知识产权犯罪的规制应以平台为切入点:其一,平台责任的有无与大小应采行为标准而非身份标准;其二,应在侵害知识产权类罪名增设“平台共犯条款”;其三,引入红旗规则扩大拒不履行信息网络安全管理义务罪的张力。The rise of the Internet society has not only expanded the field of action,but also profoundly changed the normative structure of Internet intellectual property crimes.Intellectual property crimes in the real society present a single normative structure centered on content parties while cyber intellectual property crimes show a composite normative structure with dual cores of content parties and channel parties(network platforms).The current intellectual property protection system based on the"notice-delete"rule and intellectual property infringement crimes has limited effectiveness in practice:the former improperly compresses platform responsibilities;the latter ignores platform responsibilities.The crime of refusing to perform information network security management obligations makes it possible to provide a system for pursuing the platform's network intellectual property protection responsibilities,but it also faces problems such as unclear scope of obligations and narrow scope of application.The regulations of network intellectual property crimes should start from the platform:first,the existence and size of platform responsibilities should be based on behavioral standards rather than identity standards;second,a"platform accomplice clause"should be added to the crimes of intellectual property infringement;third,the introduction of red flag rules expands the tension of the crime of refusing to fulfill information network security management obligations.
