摘 要:近年来,互联网不正当竞争案件与日俱增,虽然2017年《反不正当竞争法》新增的互联网专条以及其他类型化条款在司法机关审理该类案件时起到了举足轻重的作用,但实证考察发现,一般条款仍为适用频率最高的条款。司法机关在适用一般条款审理互联网不正当竞争案件时,在行为认定模式、消费者利益考量、商业道德认定等方面存在困境。鉴于此,建议正视互联网不正当竞争行为的特殊性,转变行为正当性认定模式为三元目标保护模式,基于互联网经济特征考量消费者利益,明确互联网领域商业道德裁判的参考依据,从而规范互联网领域一般条款的司法适用。In recent years,the number of Cases of Internet unfair competition has been increasing day by day,although the new Internet articles and other types of provisions added to the Anti-Unfair Competition Law in 2017have played a pivotal role in the trial of such cases by judicial organs,empirical investigation has found that the general clauses are still the most frequently applied clauses.When applying the General Provisions to try Internet unfair competition cases,judicial organs have difficulties in terms of behavior determination models,consumer interest considerations,and business ethics determinations.In view of this,it is recommended to face up to the particularity of unfair competition on the Internet,change the mode of determining the legitimacy of behavior into a three-dimensional target protection model,consider the interests of consumers based on the characteristics of the Internet economy,and clarify the reference basis for business ethics adjudication in the Internet field,so as to regulate the judicial application of general provisions in the Internet field.
