摘  要:作为历史上丝路文明的重要参与者和缔造者之一,阿拉伯国家身处“一带一路”交汇地带,是共建“一带一路”的天然合作伙伴。随着中阿间国际投资活动的日益频繁,国际投资争端也不可避免地随之出现。本文认为,目前中阿之间以双边投资协议(BITs)为主要形式建立起来的投资争端解决机制在投资者的法律地位、投资者-东道国争端解决机制(Investor-State Dispute Settlement,ISDS)条款以及仲裁方式等方面存在不足。在“双循环”战略下,中国对阿拉伯国家投资将呈现大幅增长趋势,同时也将导致投资实践对争端解决机制的需求变得愈加强烈,处理好中阿在国际投资领域关系的关键在于对现有的中阿投资争端解决机制加以完善。As one of the important participants and founders of the Silk Road civilization in history,Arab countries serve as the hub of“Belt and Road”and are significant partners in the construction of“Belt and Road”.With the increasing frequency of China-Arab international investment,disputes have also emerged.It’s believed that the current dispute settlement mechanism,mainly in the form of bilateral investment agreements(BITs),is flawed in terms of the legal status of investors,the Investor-State Dispute Settlement(ISDS)provisions and arbitration.Under the“dual circulation”strategy,Chinese investment in Arab countries has increased significantly and the need for a dispute settlement mechanism has become increasingly urgent.It can be said that the key to handling Sino-Arab ties in the international investment field lies in the establishment of a perfect dispute settlement mechanism.
