摘　　要：信息时代下互联网产业的发展,让用户生成内容(UGC)迸发出新的活力。为了促进知识的创新、平衡各方利益,有必要对其在著作权法中的定位与所涉专有权利进行相应的认定与分析。著作权合理使用制度就是为了平衡著作权人、公众和后续创作者之间的利益,与用户生成内容中的主体有契合之处,但在实际适用时,该项制度还是难以调整用户生成内容这一整体性模式。我国新《著作权法》对作品开放化调整“三步检验标准”的纳入以及具体条款类型的修订,为用户生成内容的合法化提供了相应的法律依据,但本文通过研究发现,对于迅速发展的用户生成内容这一新兴网络信息资源组织模式来说,相关法律体系还有待完善,以应对未来可能产生的新纠纷。The advancement of the internet industry in the information era has injected new momentum to user-generated content(UGC).In order to promote the innovation of knowledge and balance the interests of all parties,it is necessary to determine its position in the copyright law and the exclusive rights involved.The fair use system serves to balance the interests of copyright owners,the public and subsequent creators,and from this point of view,it’s compatible with the subjects of UGC.However,in practice,the system has failed to adjust to the model of UGC.The inclusion of the“three-step test standard”in the new Copyright Law and the revision of specific provisions have provided legal basis for the legalization of UGC.However,through research,it’s found that to cope with new disputes that may arise in the future,the relevant legal system needs improving as the organizing mode of online information such as the UGC is everchanging.
