摘 要:住宅建设用地续期的系统解决应当建立在对《民法典》续期条款进行法解释学作业基础上,探讨其再立法问题。续期条款由自动续期与续期费用授权立法两部分构成,需要深入剖析两者间的逻辑关联。同时,该项授权存在模糊性,可基于价值-权限-法秩序对续期规则再立法进行多重规制。在私法视域下健全续期制度,应当以续期权为核心概念,形成融贯的续期规则。权利人基于自动续期规定取得续期权,仍需探究权利行使规则以明确续期条件、续期主体等问题;期限延展后,应当统合法政策论与法体系论以研究续期权行使的效果规则;消灭规则方面,权利人放弃续期或出现法定事由时,自动续期不发生作用,也不会产生相应法律效果。The solution to the renewal of the right to use residential construction land should be based on the interpretation of the renewal clauses of the Civil Code,and its re-legislation should be discussed.Renewal clauses consist of automatic renewal rules and renewal fee rules,and it is necessary to deeply analyze the logical relationship between the two rules.At the same time,there is some ambiguity in the provisions of the renewal fee authorization legislation,and the legislative power of renewal rules can be regulated in multiple ways based on the value-authority-law order.The construction of renewal rules in the context of private law should take renewal rights as the core and form a consistent rule system.The automatic renewal is the acquisition rule of the renewal right,and it is necessary to explore its application conditions,the subject of renewal and other issues;After the time limit is extended,the effective rules for the exercise of the renewal right should be studied based on the integration of both theories of legal policy and legal system;In terms of termination rules,when the right holder abandons the renewal option or there are legal reasons,the automatic renewal does not take effect and produces corresponding legal effects.
