知识视角下专利联盟技术锁定效应测度研究

摘　　要：[研究目的]客观测度专利联盟技术锁定是后发国家突破既有技术范式束缚、争夺国际科技话语权的必然前提;是创新主体规避创新研发外部风险、增强知识产权竞争力的有效途径。[研究方法]立足于知识视角,首先在界定联盟技术锁定是由直接垄断和间接影响的技术创新知识构成的基础上,通过专利语义链和生态位互补理论识别联盟技术锁定的技术创新知识;其次利用勒纳指数、边际效益、Jaccard相似性系数构建专利联盟技术锁定测度公式;最后,选取MPEG-4专利联盟和相关产业专利数据进行实证研究。[研究结论]MPEG-4专利联盟一是构建以联盟专利产物或者方法为上游,以拥趸者专利为下游的专利技术链;二是构建基于产业共性竞争资源的差异化专利,控制了产业技术创新知识,对产业形成了较强的技术锁定现象。在丰富专利联盟技术锁定研究的同时,为后发国家实现技术锁定的主动解锁提供了建议。[Research purpose]Objectively measuring the technology locking of patent alliances is an inevitable prerequisite for late-developing countries to break through the constraints of existing technology paradigms and compete for the right to speak in international science and technology;it is an effective way for innovation subjects to avoid the external risks of innovation R&D and enhance the competitiveness of intellectual property rights.[Research method]First,through theoretical derivation,it defines alliance technology locking as identifying the innovative knowledge locked in the technology of alliance formation through patent semantic chain and ecological niche complementary theory based on the complementary innovation knowledge composition with direct control and influence;Second,it constructs a patent alliance technology lock-in measure formula using Lerner index,marginal benefit,and Jaccard similarity coefficient;Finally,it uses the MPEG-4 Patent Alliance and related industry patent data for empirical analysis.[Research conclusion]The MPEG-4 patent alliance builds a patent technology chain with the alliance's patent product or method as the upstream and the advocate's patent as the downstream,and constructs differentiated patents based on the industry's common competitive resources to control the industry's technological innovation knowledge and form a strong technology locking phenomenon for the industry.The research not only enriches patent alliance technology locking research but also provides recommendations for late-developing countries to achieve proactive unlocking of technology locks.
