摘 要:以地方立法的方式推动我国行政法的发展在当今是一个非常关键的问题。地方立法推动行政法的发展有利有弊。就其利而言,可以补充中央立法的空缺,充实行政法体系的内容,丰富行政法制度的元素,强化行政法的实施;但也存在将地方立法作为形象工程、选择性治理、超越中央职权、威胁法制统一、立法避重就轻等风险与弊害。为了有针对性地解决上述问题,应当探索并尝试构建地方立法动议权,以《地方各级人民代表大会和地方各级人民政府组织法》为依托确立地方立法的原则,强化法律保留原则对地方立法的控制作用,在《立法法》中确立责任条款,完善地方立法的备案审查机制。Nowadays,promoting the development of administrative law in our country by the way of local legislation first is a very critical issue.Local legislation promotes the development of administrative law has both advantages and disadvantages.In terms of its benefits,it can supplement the vacancy of central legislation,enrich the content of the administrative law system,enrich the elements of the administrative law system,and strengthen the implementation of administrative law.However,there are also some disadvantages and risks,such as taking local legislation as an image project,selective governance,transcending the functions and powers of the central government,threatening the unity of the rule of law,local legislation avoiding important pointsand so on.In order to solve the above-mentioned problems in a targeted manner,we should explore and try to build the right of local legislative initiative,establish the principle of local legislation based on the the Organization Law of the People’s Republic of China for Local People’s Congresses at All Levels and Local People’s Committee at All Levels,strengthen the control of the principle of legal reservation on local legislation,establish liability clauses in the Legislation Law and improve the filing and review mechanism of local legislation.
