摘　　要：建设工程价款优先受偿权在本质上是法定担保物权,其不同于留置权,亦非法定抵押权;其法律构造宜理解为工程价款债权和优先权的结合,而非能够优先受偿的债权。建设工程价款优先受偿权的请求主体并不限于承包人,还包含勘察人、设计人、合法分包人、合法次承包人及实际施工人在内,但材料供应商不在其中,该权利的行使期间宜为建设工程价款优先受偿权能被承包人行使之日起算。建设工程价款优先受偿权优于抵押权和其他债权,但有如下例外情形:其一,在以建设工程为标的物的抵押权设立之后,若发包人和承包人变更建设工程价款,则此时建设工程价款优先受偿权优先于抵押权仍宜以原建设工程价款的数额为限;其二,购房消费者的商品房买卖合同项下的债权不应优先于建设工程价款优先受偿权。In essence, the priority of payment of construction project price is the legal security interest, which is different from the lien and is not the legal mortgage right. Its legal structure should be understood as the combination of project price creditor’s right and priority, rather than the creditor’s right that can be paid priority. The subject of the priority of payment of construction project price is not limited to the contractor, but also includes the surveyor, designer, legal sub-contractor, legal sub-contractor and the actual constructor, but not the material supplier;The exercise period of the right shall be from the date when the contractor could exercise the priority right to receive payment from the construction project price. The priority of payment of the construction project price is superior to mortgage and other creditor’s rights, with the following exceptions: First, after the establishment of the mortgage right for the subject matter of the construction project, if the owner and the contractor change the construction project price, at this time the priority to receive payment should be limited to the amount of the original construction project price. Secondly, the creditor’s rights under the deal contract of commodity houses should not be prioritized over the priority of payment of the construction project price.
