摘　　要：体育仲裁是基于当事人自愿选择的协议仲裁,当事人可以根据仲裁协议、体育组织章程、体育赛事规则等申请仲裁。新修订的《中华人民共和国体育法》创制性地增设体育仲裁制度,通过“列举+排除”的立法表述方式,明确了体育仲裁范围,为化解体育领域矛盾纠纷提供了制度保障。体育仲裁范围的确定,立足国情实际,聚焦体育领域突出难题,注重做好与其他纠纷解决机制的协调,依法维护国家主权。Sports arbitration is an agreed arbitration based on the voluntary choice of the parties.The parties may apply for arbitration according to the arbitration agreement,the constitution of sports organizations and the rules of sports events,etc.The newly revised Sports Law creates a new sports arbitration system.Through the legislative expression of“enumerate+exclude”,the scope of sports arbitration is clarified,which provides a legal guarantee for resolving conflicts and disputes in the field of sports.The determination of the scope of sports arbitration shall be based on the national conditions,focus on the prominent problems in the field of sports,pay attention to coordination with other dispute settlement mechanisms,and safeguard state sovereignty in accordance with the law.
