摘 要:数字贸易是新型国际贸易模式,在全球引起广泛关注,各国都在积极参与多边和区域贸易协定(RTA)数字贸易规则谈判,以促进本国数字贸易的发展,提升在全球数字价值链中的竞争力。本文梳理了中国区域贸易协定中数字贸易规则条款的发展历程,可分为三个阶段:初级阶段重在降低贸易成本,雏形阶段开始出现电子商务章节,发展阶段涉及数字贸易多个领域。中国RTA数字贸易条款的特点表现在:基于促进数字货物贸易的立场,条款内容广度与深度有待拓展,中国RTA中数字贸易相关议题的谈判针对不同利益诉求存在异质性。在未来RTA谈判中,应积极规划符合自身发展阶段的RTA数字贸易规则,加快现有FTA协议中关于数字贸易规则的升级,以突出中国特色。Digital trade is a new model of international trade,which has aroused widespread concern around the world.Countries are actively participating in the negotiation of digital trade rules in multilateral and regional trade agreements(RTAs)to promote the development of their own digital trade and enhance their competitiveness in the global digital value chain.This paper combs the development process of digital trade rules in China’s regional trade agreements,which can be divided into three stages:the primary stage focuses on reducing trade costs,the embryonic stage begins to appear e-commerce chapters,and the development stage involves multiple fields of digital trade.The characteristics of China’s RTA digital trade terms are as follows:based on the position of promoting digital goods trade,the breadth and depth of the terms need to be expanded,and the negotiations on digital trade related issues in China’s RTA are heterogeneous with respect to different interests.In the future RTA negotiations,we should actively plan RTA digital trade rules in line with our own development stage,and accelerate the upgrading of digital trade rules in existing FTA agreements to highlight Chinese characteristics.
