摘　　要：2020年4月29日《中华人民共和国固体废物污染环境防治法》经第二次修订后正式颁布,此次修订以生态文明思想和绿色发展理念为指引,细化严格政府部门和企业主体责任,拓展固体废物管控范围,加强全过程精细化管控,全力推进固体废物减量化、资源化和无害化。实施以来,各地区结合实际陆续制定、修订了地方固体废物管理法规,重点解决了固体废物存量、回收利用、生活垃圾分类、收集处置等行为规范、信息化管理以及违法行为约束力等方面存在的问题。今后,地方在立法及管理实践中,应进一步实施固体废物分级分类管理和全过程严格管控,加强收集处置等设施能力建设和规划,提升固体废物回收利用能力,实现固体废物减量化和无害化。The Law on the prevention and control of environmental pollution by solid waste was released on April 29, 2020,after a second thorough revision. The revision has highlighted the ecological civilization and the green development, specified government’s responsibilities and strengthened business’ liabilities, expanded its coverage including solid waste types and sites, and placed more stringent requirements on the whole life cycle management, achieving the targets of reduction, resource utilization and harmless treatment. Some provincial regions have taken the lead in making or revising their regulations since the law took effect,which mainly address the mass stock of the industrial solid waste, low recycling rates, lack of detailed works in promoting garbage sorting and improper collection and disposal practices. It also pointed out to establish the information-based supervision system and enhance the crackdown on environmental violations. However, local legislation and management should be further focused on solid waste classification with a whole life assessment. It should improve the capability of the system to collect, recycle and utilize the solid waste and make them harmless.
