纸域司法改革的方向标:数智时代的区块链司法——以《最高人民法院关于加强区块链司法应用的意见》为中心展开

摘　　要：传统纸域司法的数智化变革标志着以“案牍”为通信纽带的传统司法模式转向以“数据”的部署与通信为核心的未来司法模式。这种转向在中国的建设需求表现为形成区块链为核心的司法数据联盟式部署与分散式通信。最高院推动的区块链司法可组织司法权力主体、司法对象及公众成为线上诉讼节点,参与数智司法的数据布控,形成多方线上互信数据体系。数智司法中的技术规则法律化以及信息交互数智化带来司法模式的转变。数智化将彻底改写纸域司法建立的诸如“单点举证”、“文书思维”等案牍法律文化。纸域司法终将为“分散群证”、“数智逻辑”法律文化下的数智司法所取代。来自东方的区块链司法必将成为世界数智司法的缔造者与先驱者。The digital and intellectual transformation of traditional paper domain judicature marks that the traditional judicial model with“files” as the communication link has turned to the future judicial model with “data” deployment and communication as the core. The construction demand of this shift in China is manifested in the formation of judicial data coalition deployment and decentralized communication with the blockchain as the core. Blockchain justice promoted by the Supreme People’s Court can organize judicial power subjects, judicial objects and the public to become online litigation nodes, participate in the data distribution and control of digital intelligence justice, and form a multi-party online mutual trust data system. The legalization of technical rules and the digitalization of information interaction in digital intelligence justice have brought about the transformation of judicial mode. Digital intellectualization will completely rewrite the legal culture of paperwork established in paper domain judicature, such as “single point proof” and “document thinking”. The paper domain justice will eventually be replaced by the digital intelligence justice under the legal culture of “decentralized group evidence” and “digital intelligence logic”. Blockchain justice from the East will certainly become the founder and pioneer of digital intelligence justice in the world.
