论责令改正与行政处罚制度的分裂、统一与完善

摘　　要：责令改正与行政处罚二者本质同一,都是行政机关作出的要求特定行政违法责任主体就其违法行为承担相应行政法律责任的具有法律约束力的法律意思表示。但是,我国现有立法对二者作出了本质相异的错误认定,且此项认定引发了二者程序规范体系的二元分裂与二者自由裁量规范体系的二元分裂。这三项问题共同铸成责令改正与行政处罚制度的二元分裂格局。为解决这些问题,应将责令改正与行政处罚合并为一元的行政责任命令,将责令改正与行政处罚程序规范体系整合升级为行政责任命令程序规范体系,将责令改正与行政处罚自由裁量规范体系整合升级为行政责任命令自由裁量规范体系,从而将内在分裂的责令改正与行政处罚制度整合升级为统一的行政责任命令制度。The essence of correction order and administrative punishment is the same. They are both the legally binding legal expressions made by administrative agencies that require specifi c subject of administrative illegal liability to bear the corresponding administrative legal liability for their illegal acts. However, the current legislation in China has made a wrong identifi cation of them that they are dif ferent in nature,and this recognition caused a binary split in their procedural legal systems and discretionary legal systems, and of which formed a dual split pattern of correction order and administrative punishment system. In order to solve this problem, the correction order and administrative punishment should be merged into a single administrative liability order, the correction order and administrative punishment procedural legal systems should be integrated and upgraded to administrative liability order procedure legal system, and the correction order and administrative punishment discretionary legal systems should be integrated and upgraded to administrative liability order discretionary legal system. Thus, the internal spilt system of correction order and administrative punishment is integrated and upgraded into a unifi ed administrative liability order system.
