摘 要:对于用人单位未足额缴纳工伤保险费导致的工伤保险待遇差额给付问题,应当基于工伤保险的社会保险模式,明确公法规范在私法上的效力,承认社会权损害的公法救济与私法救济的兼容性、工伤保险的保险责任和用人单位侵权之债的包容性。依效率和公平原则界定工伤保险基金给付义务、依过错责任及激励原则确定用人单位给付义务并调适两者之间的给付边界,从而在此基础上确定工伤保险待遇差额给付规则。As for the issue of payment of the deficiency of work-related injury insurance benefits,we should clarify the validity of public law norms in private law,recognize the compatibility of public law relief and private law relief for social rights damage,as well as the inclusiveness of work-related injury insurance liability and the tort liability on this basis of the social insurance model of work-related injury insurance.We should define the payment obligation of the work-related injury insurance fund according to efficiency and fairness,determine the payment obligation of the employer according to the principle of liability for wrongs and incentive,adjust the payment boundary between the two,so as to determine payment rules of the deficiency of work-related injury insurance benefits.
