摘 要:实效性是生态环境损害赔偿磋商的重要评价指标。从生态环境损害赔偿磋商立法实践来看,当前我国生态环境损害赔偿磋商实效性的发挥仍面临磋商主体设置合理性不够、磋商程序设计可操作性不强、磋商内容设定科学性不足等诸多制约因素。为进一步提升生态环境损害赔偿磋商的实效性,未来应以制定国家层面生态环境损害赔偿磋商的专门性规范文件为基础,重塑磋商的主体格局、优化磋商的程序规则、完善磋商的具体内容。Effectiveness is an important evaluation indicator of eco-environmental damages compensation negotiation.Judging from the legislative practice of eco-environmental damages compensation negotiation,one can conclude that the effectiveness of the eco-environmental damages compensation negotiation still has many constraints in China,such as lack of rationality in setting the subject involved in the consultation,lack of the operability of the negotiation program design and lack of scientific setting of the content of the negotiation.Therefore,to further enhance the effectiveness of the compensation negotiation on eco-environmental damages,it is essential to formulate national specialized normative documents for the compensation negotiations as a starting point,and to reshape the composition of the main consulting subjects and to improve the procedural rules and the specific content of the consultation.
