摘　　要：目的:分析医疗损害责任纠纷的特征及侵权情况,为预防和解决医疗纠纷提出可行性建议。方法:通过中国裁判文书网公布的审判案例,对2018~2020年354份济南市医疗损害责任纠纷判决书进行统计分析。结果:医疗损害责任纠纷案件主要集中在三级医院82.77%(293/354);医院承担侵权责任的程度主要集中在次要责任42.09%(149/354);发生侵权纠纷的科室主要集中在急诊科13.56%(48/354);损害结果主要集中在患者发生死亡情况43.22%(153/354);造成医疗损害责任纠纷的侵权原因主要集中在治疗技术问题67.80%(240/354)。结论:医疗机构应提高医院管理能力及医护人员诊疗水平,针对风险频发的医院及高危科室做好事前控制措施;通过医疗再教育管理体制不断提高医护人员的卫生法律意识,并结合本院自身情况制定及实施医疗纠纷风险预防与处理制度,构建医疗风险管理体系。Objective To analyze the characteristics and torts of medical liability disputes,and put forward feasible suggestions for prevention and settlement of medical disputes.Methods 354 judgments of medical damage liability disputes in Jinan from 2018 to 2020 were obtained from the trial cases published on China judicial documents network,and statistically analyzed.Results Medical liability disputes mainly concentrated in tertiary hospitals,accounting for 82.77%(293/354).The degree of tort liability by hospitals mainly focused on secondary liability,accounting for 42.09%(149/354).The departments with infringement disputes were mainly concentrated in emergency department,accounting for 13.56%(48/354).And the damage results mainly focused on the patients’death,accounting for 43.22%(153/354).The tort causes of medical liability disputes mainly focused on technical problems of treatment,accounting for 67.80%(240/354).Conclusion Medical institutions should improve hospital management ability and medical staffs’diagnosis and treatment level,take pre-control measures for hospitals with frequent risk and high-risk departments,improve medical staffs’health legal consciousness,and build medical risk management system.
