摘　　要：数字经济的勃兴催生了数据这一关键生产要素,厘清数据要素价值的释放机制与实现路径,推动数据共享与公平流通,对提升国家综合实力、增强国际竞争力具有重要战略意义。当前,数据要素市场垄断形势较为严峻,数据的价值释放过程受阻。一方面,数据垄断行为界定标准不清,产权制度缺失;另一方面,反垄断治理的收益与弊端难以平衡,应尽量避免破除垄断可能带来的负面效应。要破解反垄断治理的困局,一是需要规范数据垄断行为的界定标准,建立数据产权制度,构建数据安全治理体系;二是要不断完善数据反垄断监管机制,加快培育良性的数据要素市场生态体系,多措并举优化反垄断治理模式;三是增强数据主体对个人数据的控制力,提升数据流通渠道的分散度与灵活性。With the vigorous development of the digital economy,data has become a key factor of production in the new economy and is injecting strong momentum into the global economic recovery and capacity optimization and adjustment.Clarifying the value release mechanism and realization path of data elements,and promoting data sharing and fair circulation arc of great strategic significance for enhancing national comprehensive strength and enhancing international competitiveness.At present,the monopoly situation of data element market is relatively severe,the release process of data value is blocked,and antimonopoly governance is imminent.However,the following problems still need to be solved:first,the definition standard of monopoly behavior is unclear,second,the data property right system is missing,and third,the benefits and drawbacks of data anti-monopoly governance arc difficult to balance.Therefore,in order to solve the dilemma of anti-monopoly governance,we need to standardize the definition standard of data monopoly behavior,establish the data property rights system,build the data security governance system,improve the data anti-monopoly supervision mechanism,speed up the cultivation of a benign data element market ecosystem,and take multiple measures to optimize the anti-monopoly governance model to achieve long-term governance.
