基于网络直播“擦边球”现象分析直播平台管理问题及整治路径

摘　　要：“互联网+经济”的时代背景下,网络直播迅速风靡全球并催生了大量网络直播平台运营商。这是一种依托于网络架构的新型娱乐化营销方式,并使得“网络直播经济”迅速繁荣,当然,大量网络直播乱象也应然而生。网络直播“擦边球”行为就是一种具体类型化的的网络直播乱象。而就目前国内法律法规和直播平台监管机制都难以彻底杜绝该类行为,这使得“擦边球”行为层出不穷,其严重阻碍了网络直播平台的市场发展、恶化了网络直播的健康环境、危害了未成年人的身心健康,甚至触犯了法律法规的底线,我们应亮出“规制利剑”去彻底肃清该类破坏网络秩序的乱象行为。In the era of“Internet+economy”,live streaming has quickly become popular around the world and given birth to a large number of live-streaming platform operators.This is a new entertainment marketing method based on the Internet,which makes the internet live-streaming economy flourish rapidly.At the same time,a lot of webcast chaos is spawned.The webcast of“skirting libel law”,a specific type of webcast chaos,cannot be effectively regulated through the existing domestic laws and the supervision mechanism of webcast platform.However,the endless behavior of webcast of“skirting libel law”has seriously hindered the market development of the webcast,deteriorated the healthy environment of the webcast,harmed the physical and mental health of minors,and even violated the bottom line of laws.So serious regulation should be shown and enforced to completely eliminate this kind of chaotic behavior that destroys the network order.
