摘　　要：食品企业生产过程不可避免地会产生废水,一旦废水出现超标排放,造成环境污染损害,经查处后则需要对其进行鉴定评估。本文主要分析了食品废水超标排放案件的环境污染损害鉴定评估,通过对环境损害的具体量化、生态环境部门与涉案企业的积极磋商,促使企业承担起生态环境损害赔偿的主体责任,增强守法意识。The production process of food enterprises will inevitably produce wastewater,once the wastewater is discharged beyond the standard,causing environmental pollution damage,it needs to be identified and assessed after investigation.This paper mainly analyzes the identification and assessment of environmental pollution damage in the case of excess discharge of food wastewater,and urges enterprises to assume the main responsibility of ecological environment damage compensation and enhance the awareness of abiding by the law through the specific quantification of environmental damage and the active consultation between the ecological environment department and the enterprises involved.
