摘　　要：环境治理合作协议是助力实现环境治理最佳效果的重要途径。基于理性人视角的理论分析和囚徒困境模型的现实推演,可以发现私人权益保护是确保环境治理合作协议效果的重点。政府单方变更权极易对私人权益造成侵害,虽然基于公共利益其存在具有合理性,但现实中政府单方变更权的实施容易异化,需要对其进行限制。环境治理合作协议中的政府单方变更权行使应以法律原则为主,以利益评价为辅,综合考虑行政目的紧迫性和必要性。可以通过自我规制和司法规制对政府单方变更权进行适当限制,确保环境治理合作协议中的私人权益能够得到公平维护。司法审查的重心在于私人权益的保护,需针对不同情况分别适用不同的审查标准。The environmental governance cooperation agreement is an important way to help achieve the best effect of environmental governance. Based on the theoretical analysis from the perspective of rational man and the realistic deduction of the prisoner’s dilemma model, it can be found that the protection of private rights and interests is the key to ensure the effect of the environmental governance cooperation agreement. The government’s unilateral change right is easy to infringe on private rights and interests. Although its existence is reasonable based on the public interest, the implementation of the government’s unilateral change right is easy to alienate in reality, so it needs to be restricted. The exercise of the government’s unilateral change right in the environmental governance cooperation agreement should be based on legal principles, supplemented by interest evaluation, and comprehensively consider the urgency and necessity of administrative purposes. The government’s unilateral change right can be appropriately restricted through self-regulation and judicial regulation to ensure that the private rights and interests in the environmental governance cooperation agreement can be fairly maintained. The focus of judicial review is the protection of private rights and interests, and different review standards should be applied to different situations.
