摘 要:校内申诉是高校教师权益救济重要方式,但在制度设计上尚存不足,如适用范围宽泛,致使权益救济诉求易被推诿;负责处理机构的人员构成模糊,裁决者中立地位无保证;对申诉处理时限不明,易致救济正义迟来;辅助措施缺失,救济公正无有效制度保障;裁决效力不明,救济制度作用大打折扣;程序违法无制裁,实体公正缺失程序保障。对适用范围采取简单列举与兜底条款相结合,合理确定裁决机构人员占比,设定各环节处理时限,构建确保救济公正的辅助措施,明确裁决效力,实施程序制裁,是完善校内申诉制度的路径选择。In-school appeal is an important remedy for protecting teachers’ rights, but there are still some deficiencies in the system design, such as: The scope of application is wide, resulting in equity relief claims easy to be prevarication;The composition of adjudication bodies is ambiguous, the neutral position of adjudicator is not guaranteed;The time limits of handling complaints is unclear, which is easy to cause relief justice to come late;Lack of auxiliary measures, and there is no guarantee of effective system for relief and justice;The effectiveness of the adjudication is unclear, and the relief system is greatly reduced;Procedural illegal no sanctions, entity justice is lack of procedure guarantee;It is the path choice of improving the appeal system of the university to combine the scope of application and the simple list of the provisions for the bottom of the application, reasonably determine the proportion of the personnel of the ruling organization, set the processing time limit of each link, construct the auxiliary measures to ensure the relief justice, clarify the effectiveness of the ruling, and implement the procedural sanctions.
