摘  要:长期以来,人们关注教育惩戒权,更多的是关注中小学及其教师的教育惩戒权,高等学校的学生一般均已成年,高等学校的教育惩戒与中小学教育惩戒应具有不同的内涵。明确高等学校教育惩戒权的主体、范围以及教育惩戒应遵循的正当程序、救济途径,探索一种能够平衡“大学自治”与“依法治校”的高校教育惩戒权规范路径,是高等教育的现实所需。For a long time, people have paid attention to the right of education punishment. But more attention has been paid to the right of education punishment of primary and secondary schools and their teachers. Students in colleges and universities are generally adults, so the education punishment should have different connotations from that of primary and secondary schools. It is necessary for the reality of higher education to clarify the subject and scope of the disciplinary power of institutions of higher learning, as well as the due process and relief channels that should be followed by educational punishment, and to explore a standardized path of the disciplinary power of colleges and universities that can balance "university autonomy" and "rule by law".
