摘　　要：《国籍法》台湾地区实施方案,是探索“两制”台湾地区方案不可回避的重要议题。设计《国籍法》台湾地区实施方案需要兼顾“一国”与“两制”、明确界定适用范围、解决国籍冲突问题,以及应对外部势力可能的干涉。《国籍法》香港地区实施方案关于国籍认定、减少和消除国籍冲突、国籍管理机构设置,以及应对外部势力干涉等做法,对设计《国籍法》台湾地区实施方案具有重要的借鉴意义。但台湾地区问题与香港地区问题有根本性差异,《国籍法》台湾地区实施方案应贯彻国家主权统一原则,废止台湾地区现行的“国籍管理制度”“国籍管理机构”“中华民国国籍”及相关旅行证件和身份证明文件,主动消除统一后台湾同胞的国籍冲突,不承认外国所颁发旅行证件的国籍证明文件效力,考虑国籍管理机构的设置及权限安排,从而实现“一国两制”下台湾地区的长治久安。The implementation of the Nationality Law of the People’s Republic of China in Taiwan region is an important issue that cannot be avoided in the exploration of the Two Systems solution to the Taiwan question. The design of implementation of the Nationality Law in Taiwan region requires a balance between “One Country” and “Two Systems”, a clear definition of the scope of application, the resolution of nationality conflicts, and the respond to possible interference by external forces. In the implementation plan of the Nationality Law in Hong Kong, the practices of nationality determination, the reduction and elimination of nationality conflicts, the establishment of nationality management agencies, and the respond to external interference are important references for the design of the implementation of the Nationality Law in Taiwan region. However, the Taiwan question is fundamentally different from the Hong Kong question. The implementation plan of the Nationality Law in Taiwan region should carry out the principle of national sovereignty and unity, abolish the existing “nationality management regulations”, “nationality management agencies”, “the nationality of the ROC”, related travel documents and identity documents in Taiwan region, take the initiative to eliminate conflicts over the nationality of Taiwan compatriots after reunification, do not recognize the validity of nationality documents issued by foreign countries, and consider the establishment and authority of nationality management agencies, so as to achieve long-term stability in Taiwan under “One Country, Two Systems”.
