摘 要:作为农业的“芯片”,种子是保障粮食安全的关键。本研究分析中国种业产业安全法律制度的现状,从安全的角度指出当前中国农业种子法律体系存在的科研安全、市场监管、产业服务等法律问题,同时分析种子产业现存问题形成的主要原因,进一步提出解决中国种子产业安全问题的法律体系完善建议,以期为优化种子产业的科研创新制度、强化种子产业市场动态监管体制、完善中国种子产业外资准入制度、健全中国种子产业信息开放政策提供参考。As the "chips" of agriculture, seeds are the key to food security. The development of seed industry also determines the national economy. This study analyzes the current situation of China’s seed industry security legal system, and points out the legal problems of China’s current agricultural seed legal system, such as scientific research security, market supervision, and industrial services, At the same time, it analyzes the main reasons for the formation of the existing problems in the seed industry, and further puts forward suggestions for improving the legal system to solve the security problems of China’s seed industry, with a view to providing reference for optimizing the scientific research and innovation system of the seed industry, strengthening the dynamic supervision system of the seed industry market, improving the foreign capital access system of China’s seed industry, and improving the information opening policy of China’s seed industry.
