主观程序正义理论中国化的逻辑及其展开

摘　　要：当代中国全面推进依法治国需要在社会中培育程序正义理念的内生性动力,主观程序正义理论因其社会实证的研究方法而可能成为推动程序正义理念内生化的切入点。传统上的主观程序正义理论研究主要基于跨文化研究模式,这种模式存在过于强调文化因素、忽视社会动态发展、滥用“集体主义”观念等问题。主观程序正义理论的中国化需要超越此种模式,直面中国法治实践,将“文化”概念具体化、回到事实本身发掘理论与实践相结合的着力点、在全面推进依法治国的理论体系中恰当定位。在具体研究中,前述逻辑的展开表现为在政策导向中寻找突破口、在典型场景中寻找事实、在主观感受中寻找制度衔接等特点。通过主观程序正义理论的中国化,推动程序正义理论的中国化和程序正义理念的内生化。Promoting the comprehensive rule of law in the current China requires the endogenous impetus of the concept of procedural justice in society,which is inseparable from the sinicization of the theory of procedural justice.Subjective procedural justice,with its social empirical research method,can become the focus of sinicization.However,the traditional research on subjective procedural justice is mainly based on the cross-cultural research model,which has some problems such as overemphasizing cultural factors,ignoring social dynamic development,and abusing the ideas of“collectivism”.The sinicization of subjective procedural justice theory needs to go beyond this mode,face China’s legal practice directly,materialize the concept of“culture”,return to the fact itself to explore the focus of the combination of theory and practice,and properly position in the theoretical system of comprehensively promoting the rule of law.In specific research,the expansion of the foregoing logic will show the characteristics that finding breakthroughs in policy orientation,finding facts in typical scenarios,and finding system connections in subjective feeling.The sinicization of subjective procedural justice theory could promote the sinicization of procedural justice theory and the endogenization of procedural justice concept.
